Terms of Service

1. Service Description

PuxadorPro MDM ("the Service") is an enterprise mobile device management platform that enables registered businesses ("Customers") to manage their company-owned mobile device inventory using Android Enterprise fully managed device mode. The Service is provided by PuxadorPro ("the Provider").

2. Eligibility & Permitted Use

The Service is available exclusively to registered businesses with a valid CNPJ (Brazilian business registration). By using the Service, the Customer represents and warrants that:

  • The Customer is a legally registered business entity in Brazil
  • All devices enrolled in the platform are company-owned assets belonging to the Customer
  • The Customer has legitimate business reasons for managing the enrolled devices
  • The Customer will comply with all applicable laws, including LGPD and the Brazilian Consumer Protection Code (CDC)
  • The Customer will inform device users about the management policies before distributing devices

3. Device Ownership Requirement

Customers may only enroll devices that they legally own. The Service is designed for managing company-owned device fleets. Devices sold outright to consumers (where ownership has fully transferred) must not be enrolled or managed through the platform. The Customer is solely responsible for ensuring that all enrolled devices are company-owned assets.

Examples of permitted use:

  • Devices owned by the business and assigned to employees or contractors
  • Devices owned by the business and assigned to users under a company usage agreement where the business retains legal title
  • Demo or display devices used in retail locations
  • Loaner devices provided temporarily to customers during service repairs

4. Android Enterprise Compliance

The Service utilizes the Android Management API provided by Google. The Customer agrees to comply with the Android Management API Permissible Usage Policies. The Provider reserves the right to suspend or terminate any Customer account that violates these policies.

5. Lost Mode & Device Lock

The Service provides Lost Mode and device lock capabilities to protect company-owned assets. These features may only be used in the following circumstances:

  • The device has been reported lost or stolen
  • The device user has violated the company usage agreement
  • The device needs to be secured for data protection purposes
  • The company usage agreement has been terminated and the device has not been returned

The Customer must maintain clear documentation of the usage agreements with device users and must attempt reasonable communication before locking any device.

6. Device Release & Ownership Transfer

When a device's lifecycle within the company is complete (e.g., usage agreement concluded, ownership transferred to the user), the Customer must promptly release the device from management through the platform. The Provider may audit compliance with this requirement.

7. Customer Responsibilities

The Customer agrees to:

  • Maintain accurate records of device ownership and enrollment
  • Provide clear written agreements to device users explaining management policies
  • Respond to device user inquiries about management policies within 48 hours
  • Release devices from management promptly upon ownership transfer
  • Not use the Service to manage devices the Customer does not legally own
  • Comply with all applicable Brazilian laws and regulations

8. Suspension & Termination

The Provider may suspend or terminate access to the Service if the Customer: violates these Terms, violates Android Enterprise policies, uses the Service for purposes other than managing company-owned devices, or fails to comply with applicable laws. Upon termination, all managed devices will be released from management within 7 business days.

9. Limitation of Liability

The Provider is not liable for any damages arising from the Customer's misuse of device management features, including but not limited to: locking devices the Customer does not own, failing to release devices upon ownership transfer, or violating device user agreements. The Customer assumes full responsibility for all device management actions taken through their account.

10. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of the Customer's registered business jurisdiction.
